CA ANZ recently provided feedback to Inland Revenue on their draft ‘question we’ve been asked’ ADV00097 whether “negative interest” payments are subject to withholding taxes. This item concludes that negative interest payments are not “interest” as defined in section YA 1. Therefore, they are not subject to withholding taxes (RWT or NRWT), nor subject to the investment income reporting requirements.
