Submission on the IGTO review of the Commissioners Remedial Power

CA ANZ has lodged a submission for the Inspector-General of Taxation and Taxation Ombudsman’s review of the Commissioner’s Remedial Power.

Chartered Accountants ANZ (CA ANZ) has lodged a submission for the Inspector-General of Taxation and Taxation Ombudsman (IGTO)’s review of the Commissioner’s Remedial Power (CRP). The IGTO commenced this review due to the observation that there is a lack of clarity about how issues are raised for CRP consideration and whether the processes underlying consideration of these matters are sufficiently robust to take into account consideration of relevant factors and expert stakeholder views.

Based on member feedback and experience with the ATO’s consultation for the proposed exercise of the Commissioner’s Remedial Power, CA ANZ has provided comments on the Term of reference in the submission. 

Overall, CA ANZ is of the view that the legislative limits to the exercise of the CRP are the main reason the CRP is not operating as effectively as it could be when dealing with making minor changes to provisions to overcome unintended or inadvertent outcomes.
